The core grievance is the illegal bifurcation and denial of full X Group Pay (₹6200) to Pre-2016 Veterans under OROP-2 and OROP-3, while Post-2016 personnel receive the full benefit. This is challenged as discriminatory and a violation of the constitutional principle of 'equal pension for equal rank and equal length of service'.

Detailed List of Cases Before the Hon'ble Supreme Court

  • WP(C) 796/2023 – Sushil Kumar Choudhary & Others: The Lead Petition challenging Table Nos. 7 & 8 of OROP-2 and OROP-3 as arbitrary and discriminatory.
  • WP(C) 1324/2023 – TAVWA: The 1st Tagged Petition by the Technical Air Veterans Welfare Association. It's grounded in Cabinet approval and MoD's own circulars, giving it exceptional legal weight.
  • WP(C) 126/2024 – WARMIN: The 2nd Tagged Petition filed on behalf of Retired Naval Mechanics, reinforcing the claim of illegal selective granting.
  • WP(C) 391/2025 – Veterans Indian Navy Direct Entry Artificers: The 3rd Tagged Petition, recently tagged and awaiting compliance.

Current Status: All petitions are being heard together. Once compliance is completed for the recently tagged cases, the entire bunch will be listed before the CJI’s Court for a substantive hearing.

Timeline of X Group Pay Evolution

2006 (6th CPC) Introduction of ₹1,400 X Group Pay – a legally sanctioned varying benefit for X Group PBOR.
2016 (7th CPC) Enhancement & bifurcation: ₹6,200 for AICTE-qualified; ₹3,600 for non-AICTE-qualified. A new legal varying benefit is created.
2016 onwards Higher X Group (₹6,200) forms a single, homogeneous class based on qualification.
2023 (OROP-2) Illegal & arbitrary split: Pre-2016 AICTE-qualified veterans are downgraded to ₹3,600 for pension, creating an unlawful "class within a class."
